Federal judge rejects career criminal Cambodian national’s detention appeal

Federal Judge Paul Magnuson has rejected the detention appeal of a Cambodian national being held for removal from the United States, ultimately stating that the prisoner failed to prove that officials didn’t follow their own regulations.
Pov Beng filed his habeas corpus petition back on July 7. He has a long criminal history, Alpha News reports. He drew the short straw of having his case assigned to district Judge Magnuson. Had his case been assigned to one of several other federal judges in the Minnesota district, Beng’s release would have been a near certainty.
I have been tracking every habeas corpus case filed in Minnesota involving an illegal alien since late March, totaling some 315 cases. These are part of more than 1,400 such habeas cases filed in Minnesota since the start of the year.
The outcomes of most cases fall into a handful of buckets that don’t necessarily provide clear wins for either side. Cases are either still pending, transferred to other districts, dismissed, or sent to bond hearings in Immigration Court.
Of the 272 habeas cases filed between March 25 and August 4, 133 cases were decided on the merits with 41 petitions denied outright and 92 detainees released. Among the district judges, the semi-retired Magnuson has denied the most petitions (12). Judge Jeffrey Bryan has ordered the most releases (21). Neither judge has decided a case in the opposite direction during this period.
