Bill Melugin of national Fox News reports this afternoon an exclusive,

It’s a complicated story. Marcotulio Melendez Diaz, 42 of Honduras and billed out of Little Canada, was taken into custody in Minnesota in January during Operation Metro Surge. He was transferred down to an ICE detention facility in Texas. A habeas corpus case was filed in Texas in March and a Texas-based federal judge ordered the release of Melendez in August on due process grounds.

Melendez is an illegal alien who entered America in April 2024, during the Biden Administration. District Judge Orlando Garcia, a Clinton appointee, freed the Honduran-citizen Melendez citing the 5th amendment to the U.S. Constitution’s “due process” clause as the basis for his ruling. Garcia had earlier served as the Western District’s Chief Judge.

Melendez made his way back up to Minnesota after his release. He is now accused of 1st degree felony criminal sexual conduct for attacking a woman in Mounds View, Minnesota.

Ramsey County jail records indicate that he was taken into custody on October 28 and he remains in custody, originally on $200,000 bail. A Ramsey County judge lowered the bail amount to $150,000.

The alleged incident occurred on October 12. He requires a Spanish-language interpreter for his court appearances.

He is due back in state court on November 25.
