Over 240 school board members (and still growing) in 104 school districts across Minnesota are calling for the Minnesota Department of Education (MDE) and the Minnesota State High School League (MSHSL) to comply with Title IX and enter into a proposed resolution agreement offered by the U.S. Department of Education Office of Civil Rights and the U.S. Department of Health & Human Services Office of Civil Rights.
Investigations conducted by the two departments found MDE and MSHSL in violation of Title IX for allowing males to participate in female-designated athletic programs and to access female-only sensitive spaces (such as locker rooms and restrooms), which subsequently denies equal opportunities to female student athletes and jeopardizes their privacy and safety, according to the federal government’s findings. The sports male athletes have been allowed to compete in include girls Alpine skiing and Nordic skiing, girls lacrosse, girls track and field, girls volleyball, and girls softball.
MDE and MSHSL were given 10 days — which appear to expire today — to accept the terms of a proposed resolution agreement from the federal agencies to “remedy current and past discrimination, and to prevent any similar instances where future violative conduct may recur.” Failure to correct these violations risks suspension or termination of federal financial assistance.
