Loyal readers know that I’ve been following the habeas corpus/illegal alien phenomenon for more than a year now. Specifically, I’ve been tracking federal court cases (Code: 463) filed by noncitizens seeking their release from ICE custody.
The number of cases surged early this year, tracking the success of Operation Metro Surge, with about 1,500 filed so far in calendar year 2026.
Back on March 25, the 8th Circuit Court of Appeals (which covers the Minnesota federal district) issued a ruling in a Minnesota case that, yes, federal law says that aliens subject to deportation “shall be detained.” Since then, some local federal judges have followed the law, while others operate in open defiance.
I’ve tracked every case in Minnesota filed since then, numbering more than 350 submitted through Monday, September 14. You can see for yourself,, listed below.
Where a detainee’s nationality is noted in the public record, I have included that data. A number of cases are still pending before the court, so the “Outcome” is left blank until a result occurs.
